Summary

This addendum sets out the Government's policy advice on changes to the tree preservation order (TPO) system which came into full effect on 1 October 2008 and on 6 April 2009. These changes include a mandatory standard application form, fast-track appeals and a right for all parties to claim costs for all types of tree appeals.

A revised model TPO is also available below which reflects amendments to the legislation up to November 2008. This is a live document and we cannot guarantee it is an authoritive version, which is to be found in the Town and Country Planning (Trees) Regulations 1999.

The relevant legislation is contained in the Town and Country Planning (Determination of Appeals by Appointed Persons) (Prescribed Classes) (Amendment) (England) Regulations 2008 which came into force on 6 April 2008, and the Town and Country Planning (Trees) (Amendment) (England) Regulations 2008.
