This report summarises the responses to the consultation paper Overriding Easements and Other Rights: Possible Amendment to Section 237 Town and Country Planning Act 1990

The consultation paper proposed that Section 237 should be amended to make it clear that it applies to any use of land as well as 'the erection, construction or carrying out or maintenance of any building or work on land'. This would allow the subsequent use of the land to benefit from the overriding of easement etc.
