This is the first in a series of five booklets (revised versions published in October 2004), which explains, in simple terms, how the compulsory purchase system works. If you think you may be affected by compulsory purchase you should read these booklets.

This booklet explains:

  • Why there is a need to make compulsory purchase orders (CPOs)
  • Who can use these powers, and the procedure for gaining those powers
  • How the powers are implemented by the acquiring authority
  • What your rights are and what opportunities exist to resist or influence the procedure

This guidance is not a substitute for professional advice. If you think your property may be the subject of a compulsory purchase order (CPO) you should seek advice from a professionally qualified person such as a chartered surveyor or solicitor, who should be able to advise on your rights and also act on your behalf if appropriate. It is best to seek professional help as early as possible.
