Summary

This circular has been replaced by the Planning Inspectorate's Procedural Guidance: Planning appeals and called-in planning applications (PINS 01/2009) (external link).

The new guidance applies in relation to:

  • Planning appeals dealt with under written representations where the application was received by the local planning authority on or after 6 April 2009
  • Planning appeals dealt with by hearing or inquiry where the appeal was made on or after 6 April 2009
  • Called-in cases where the application, which is subsequently called-in, was made on after 6 April 2009

For transitional cases, this circular still applies.

The Secretary of State's power to determine the appeal method applies in relation to all appeals made on or after 6 April 2009, regardless of whether the appeal is following procedures set out in this circular or the Planning Inspectorate's new guidance. You will be informed of the procedures that your appeal will be following by the Planning Inspectorate.

If you have any queries please contact the case officer assigned to your appeal.
