Summary
This consultation paper sets out how the prescribed constitutional documents for right to manage (RTM) companies have been based upon a model version of these documents contained in 1985 Companies Act.
With significant changes being made to these model documents through the 2006 Companies Act it is considered appropriate that the prescribed RTM company documentation should be updated.
This will mean that the documentation and relevant requirements for new RTM Companies will be consistent with those for new companies in general. A small further amendment is being proposed to make the voting arrangements for these companies work more fairly.
