Summary

This paper is to inform Local Housing Authorities (LHAs) of recent developments concerning secure tenants who have become 'tolerated trespassers' as a result of the wording of a possession order made against them. New wording for the standard order postponing possession has been agreed, together with a new procedure leading to obtaining a warrant for eviction. The paper also gives advice to LHAs concerning the options open to them, and the provision of relevant information to tenants (including possible remedies for those who have already become tolerated trespassers).
