Summary

This guidance is statutory, but tries to avoid being prescriptive. It provides local authorities and HMOs with a framework to follow whilst allowing flexibility based on local circumstances.

It also outlines those areas which the Government expects local authorities and HMOs to have properly considered when deciding to contract out ASBO functions.

The guidance does not duplicate nor override guidance issued by the Home Office on the use of ASBOs. Rather it focuses on the contractual relationship between local authorities in their strategic role and housing managers as frontline 'deliverers'.
