Summary

The Housing and Regeneration Act 2008 introduced provisions for housing authorities to take an equity share or offer an equity loan to enable their leaseholders to meet the service charge bills relating to their flats. Regulations to give these provisions effect were brought into force on 6 April 2009.

This consultation paper seeks views on whether there should be a cap on administration fees charged by housing authorities on such arrangements, the issues surrounding capping and the appropriate level of any cap.
