Byelaws

Enacting byelaws is one way that councillors can champion the concerns of local people and tackle problems in their area. At present the Secretary of State confirms all local authority byelaws.

This section contains the arrangements and procedures for confirming byelaws, including model sets and guidance notes.

Individual byelaws can be made only under the power governing the set to which they belong and cannot be transferred between sets.

In future the Secretary of State's role in confirming byelaws will end. It will also be possible for councils to enforce byelaws through fixed penalty notices instead of imposing fines through the magistrates' courts. This will increase the effectively of byelaws in enforcing standards of behaviour in public.
