Section 27 of the Housing Act 1985, as substituted by the Regulatory Reform (Housing Management Agreements) Order 2003, sets out the power for local authorities to delegate their housing management functions, subject to the approval of the Secretary of State.
Whilst all housing management delegations require the approval of the Secretary of State a General Approval was issued in 1994 which sets out four categories of delegation that do not require specific consent. For example; a housing management agreement with a Tenant Management Organisation where the agreement conforms to the current Modular Management Agreement.
