General Consents published by the Department for the most common types of small disposal of untenanted stock or disposals to sitting tenants by local authorities and Registered Social Landlords.
There are a core set of housing provisions under which the consent of the Secretary of State is required:
Section 32 of the Housing Act 1985
for local authorities to dispose of housing land and property, whether by sale of the freehold or on leasehold terms.
Section 133 of the Housing Act 1988
for RSLs to make the first subsequent onward disposal, usually after a housing transfer. The legislation requires the Secretary of State to consult the Housing Corporation before giving consent.
Section 25 of the Local Government Act 1988
for local authorities to give financial assistance in connection with the acquisition, construction, conversion, rehabilitation, improvement, maintenance or management of privately let housing. This ranges from grants and loans through to the disposal of tenanted or untenanted property at an undervalue e.g. in exchange for the local authority receiving nomination rights.
