Eligibility for housing allocation and homelessness assistance (regulations)

Introduction

The Allocation of Housing and Homelessness (Eligibility) (England) Regulations 2006 (SI 2006 No. 1294) came into force on 1 June 2006. The regulations govern eligibility for an allocation of housing under Part 6 of the Housing Act 1996 and eligibility for homelessness assistance under Part 7 of the 1996 Act. They apply to England only and have been amended by the following regulations:

The Allocation of Housing and Homelessness (Eligibility) (England) (Amendment) Regulations 2006 (SI 2006 No. 2007) (external link) which came into force on 25 July 2006;
The Allocation of Housing and Homelessness (Miscellaneous Provisions) (England) Regulations 2006 (SI 2006 No. 2527) (external link) which came into force on 9 October 2006; and
The Allocation of Housing and Homelessness (Eligibility) (England) (Amendment) (No. 2) Regulations 2006 (SI 2006 No. 3340) (external link) which come into force on 1 January 2007.

These Regulations concern eligibility for social housing and homelessness assistance in relation to:

persons subject to immigration control; and
other persons from abroad who are not subject to immigration control

SI 2006 No. 3340 makes provision for those limited numbers of nationals of Bulgaria and Romania who will be treated as EU workers.
