This circular sets out the requirements of the Town and Country Planning (Flooding) (England) Direction 2007, which is made under the Town and Country Planning (General Development Procedure) Order 1995 (Statutory Instrument 1995 No 419).
This direction, which comes into force on 1 January 2007, is annexed to the circular. It requires local planning authorities to notify the Secretary of State of any application for major development in a flood risk area, where it is minded to grant permission against advice on flood risk grounds from the Environment Agency.
Please note: This circular has been cancelled and replaced by Circular 02/09: The Town and Country Planning (Consultation) (England) Direction 2009 with effect from 20 April 2009.
