Summary

Most private sector tenants pay a returnable deposit or bond to their landlord or letting agent. Concern about the perceived mismanagement of deposits - in particular their unfair retention - led to the setting up of a two-year pilot Tenancy Deposit Scheme (TDS) in March 2000. The pilot TDS offers a custodial scheme, whereby a third party holds the deposit, and an insured scheme in which the landlord or letting agent pays an insurance premium to ensure that the deposit will be repaid to the tenant should the Independent Housing Ombudsman (IHO) find in their favour if there is a dispute. Under both options, all disputes arising at the end of tenancies are dealt with by the IHO.
