A key purpose of the Housing Act 2004 is to improve the physical conditions of housing in all sectors, having regard to health and safety risks. A particular focus, through its licensing provisions, is to improve the management of the more difficult to manage properties in the private rented sector - Houses in Multiple Occupation (HMOs).
The consultation paper, Codes of practice for student accommodation: Approved Codes under Section 233 of the Housing Act 2004 (ODPM September 2005) was concerned with 3 codes of practice that had been submitted to the Government and which the Government was minded to approve. These were:
The consultation paper made it clear that it was on the basis of compliance with the first two of these codes that higher or further education establishments could be granted exception from HMO licensing by secondary legislation under Schedule 14 of the Act.
This paper summarises the responses to the consulation and how the Government intends to proceed in light of those comments.
